According to reports, Clare Niederhauser, of Layton, was approaching his home when he noticed that there was a car in his driveway and a man with a crowbar at the door of his house. Instead of driving away and calling police, Niederhauser fired two shots- one at the car as the driver tried to get away and another at a man fleeing on foot from his home.
Utah police said Niederhauser was arrested because he was not under any threat or risk of death or serious bodily harm at the time that he fired his handgun.
