Jury Votes Duncan Eligible for Death

A federal jury in Idaho deliberated for two hours before voting convicted sex offender and killer Joseph Edward Duncan III eligible for the death penalty in the 2005 kidnapping, torture, sexual assault and murder of Dylan Groene. Now prosecutors must convince jurors that he should be executed.

Acting as his own attorney, Duncan will be able to address the jury directly in an effort to make his case for a life sentence without parole when the hearing continues next week.

In December, Duncan pleaded guilty to kidnapping Dylan and Shasta Groene from their Coeur d'Alene home. He then took them to remote campgrounds in Montana where he sexually assaulted them, tortured and killed Dylan.
