Boicelli was arrested after DNA paternity tests proved that a former student fathered her two-year-old baby.
According to reports, Boicelli and the victim first met when the boy was 14-years-old and a student in Boicelli's eighth grade class. During the next school year, witnesses reported seeing the two together in what looked like an intimate relationship.
Boicelli was seen on a regular basis visiting the victim at his home when his mother was not home. His mother testified that Boicelli kept her son out late and that her son told her he was helping his teacher paint.
When investigators questioned the boy, he denied having intercourse with his former teacher until confronted with the DNA reports. He then changed his story and admitted to having sexual intercourse one time.
Boicelli's attorney, Terry Bowman, tried unsuccessfully to have the case dismissed because the sexual relationship may have occurred out of state. The strategy failed and a plea agreement was reached, dropping the charges to one lewd act upon child in exchange of Boicelli pleading guilty.
