Port Orange Police and Daytona Beach Police filed charges after an investigation determined that Horvath and the student engaged in sex multiple times in hotels in Port Orange and Daytona Beach.
Reports say Horvath quit after school officials confronted her about her relationship with the student.

Cynthia Horvath plead no contest to unlawful sex with a minor. She was sentenced to one year of community control, followed by seven years of probation and she must register as a sex offender for life. Other conditions of her sentence included she is not permitted with minors other than her own children, she may not drive alone and she had to surrender her teacher's license.

Cynthia Horvath was arrested on April 7, 2009, after allegedly chatting with a 16-year-old boy on Facebook. She was taken to Volusia County jail and is being held without bond. There are reports that the arrest was due to a sting operation set up by the Port Orange Police Department.
