In Virginia, NFL free safety for the Washington Redskins Sean Taylor was arrested in October 2004, for allegedly driving under the influence of alcohol following a birthday party for former Redskins' receiver Rod Gardner. At the time of his arrest, Taylor refused to take a blood alcohol test. He was later acquitted after a judge viewed a videotape of Taylor's roadside sobriety test, but convicted for his refusal to take the test. Upon appeal, Taylor was acquitted due to lack of probable cause for the police officer to request the BAC test.
