Casey Anthony to Face Murder Trial First

Rejecting a prosecution request to try the mother of missing Florida toddler Caylee Anthony on check fraud charges first, a judge has ruled that her murder trial will be held first, in January. Casey Anthony, 22, faces murder charges in the disappearance of her missing 3-year-old daughter.

Prosecutors wanted Casey tried on her check fraud charges first, apparently in hopes of locating Caylee's remains before the opening of the murder trial.

"Judicial economy may be best served by hearing the murder case first," ruled Circuit Judge Stan Strickland at a preliminary hearing on the check fraud charges.

Meanwhile, an attorney hired by Casey Anthony's defense team presented a 30-page report to prosecutors outlining reasons why she should not face the death penalty. It points out problems with some of the evidence and argues that the case does not fit the state's criteria for seeking the death penalty.

Extreme Emotional Distress?

The report from the defense is part of the process Florida prosecutor go through in deciding whether or not to seek the death penalty. Filed by Miami attorney Terence Lenamon, it is not a public record under Florida law.

Parts of the report, given to the media by Lenamon, may give a clue to Casey's defense at the murder trial.

Lenamon writes in the document that Casey was "suffering from episodes of extreme emotional distress and disturbance since her daughter's birth. Even the lack of emotion after her child's disappearance and the arrest is not normal."

The report outlines several other reasons the defense believes it is not a death penalty case.

Holes in Her Story

The then 2-year-old Caylee Anthony disappeared in June, two months before her third birthday, but was not reported missing until July. Casey Anthony told police that she dropped her daughter off at a babysitter and both the child and the babysitter were gone when she returned from work.

Police found that the apartment where Casey told them she left Caylee had been vacant for months and she was lying about where she worked and even her supervisor's name. Her story quickly did not add up to detectives.

Investigators determined quickly that most of what Casey was saying was untrue and immediately began looking at her as a suspect. She was charged with murder after DNA evidence and hair found in the trunk of the car Casey was driving pointed to human decomposition.

Though it pains me to say it I must admitt it that I do believe that Caylee Anthony is in fact deceased. People may dissagree with me but I hope that she died quickly and did not have to suffer. She is in my prayers as well as my heart. I do offer my deepest condolences to her family.

As for Casey Anthony I do believe that she will pay for her sins, if not with the law, twith God. I have nothing further to say, about Casey, exept for, may God have mercy on her soul.

I have a daughter that is 3 and a son that is 1 and it just breaks my heart to hear what happened to this helpless child what did she ever do to deserve this. I hope cassey goes to hell and does not get forgivness. My children mean the world to me. The only reason she killed little kayle was because she did not get attention anymore which is so childish.All she had to do was adopt her out to a couple that couldnt have kids!!!!She is selfish bitch that need to rot in hell for what she did!!!!No child deserves to die that way, she never should of been able to have kids in the first place! And there are probablly other mothers out there just like cassey. But they all get what they deserve in the end. And kayle can finally rest in peace.And Kayle if you can hear me I know I never mett you but you will be safe now in the hands of god!!!! Rest in Peace!!:)

I too was a young mom I was 19 when I had my daughter, I was not ready for motherhood but with the help of my parents I kept my sanity,to what degree is Casey’s parents held resonsible,how could they have not seen there daughter was in distress and that something was wrong? how could they let almost a month go by before demanding to know where their
granddaughter was?? I feel to some degree these gradndparents failed this baby girl. May god bless her little soul and may she rest in peace, let this be a lesson in reading the signs, and being aware of how young mothers can very easily become so desperate.Thanks to my mom and dad for being such great grandparents,I couldn’t have done it without you.

I have been following this case from A-1
When they had the funeral for Kalyie and the brother was talking. Remember he said “I will keep my promise CMY. ??? Did he and is sister make a deal and he would never tell anyone what really happened? What was this Promise he Promised to KEEP?? Nothing has been brought up about that when they talked with him? And they talk about RIGHTS for Cassey!!!
What about the RIGHTS HER LITTLE GIRL HAD??
She had NONE HER MOM TOOK CARE OF THAT. I really do not see how she sleeps. When they show pictures of her little girl and music with them, it breaks your heart. Does she have a HEART.
