Former Teacher Gets 6 Years in Sex Case

Tuesday September 30, 2008
A former Nebraska teacher who fled to Mexico with a 13-year-old student has been sentenced to six years in federal prison for transporting a minor across state lines to have sex. Kelsey Peterson, 26, avoided a mandatory 10-year minimum sentence by accepting the plea agreement.

Peterson still faces state charges of kidnapping and first-degree sexual assault.

Prosecutors said Peterson began having sex with the boy when he was 12 years old and a student at the middle school where she taught. But Peterson's attorney challenged the birth certificate of the boy and claimed he was at least 16 years old. James Martin Davis said the boy was the aggressor in the relationship.

Arrested in Mexico

Peterson was credited with more than a year of time served and she may get another year off for good behavior, but she will not be eligible for parole.

Peterson and the boy disappeared in October after she was questioned by investigators about her relationship with him. She was arrested a week later in Mexicali, Mexico.

Although the boy and his family were in the United States illegally, he has been returned from Mexico, reunited with his family and they are living somewhere in Nebraska.
