Poll: Are the Attacks On Elderly NYC Women a Hate Crime?

Few will disagree that the attacks on the two elderly women in New York City this week was an appaling crime motivated by the victims' age and vulnerability. Assuming the attacks were done by the same individual should the case be considered a hate crime?

According to the FBI, the definition of hate crime is, "A hate crime, also known as a bias crime, is a criminal offense committed against a person, property, or society that is motivated, in whole or in part, by the offender’s bias against a race, religion, disability, sexual orientation, or ethnicity/national origin.

However, in the Hate Crimes Act of 2000, New York State included age in its definition:

"The legislature finds and determines as follows: criminal acts involving violence, intimidation and destruction of property based upon bias and prejudice have become more prevalent in New York state in recent years. The intolerable truth is that in these crimes, commonly and justly referred to as "hate crimes", victims are intentionally selected, in whole or in part, because of their race, color, national origin, ancestry, gender, religion, religious practice, age, disability or sexual orientation."
