Judge Reconsiders Debra Lafave Plea Deal

Prosecutors joined Debra Lafave's attorneys in asking a Florida judge to reconsider their plea deal that will allow her to avoid jail time for having sex with one of her 14-year-old middle school students.

Previously the judge rejected the plea deal that would have given Lafave three years of house arrest instead of prison, saying he wanted to hear expert testimony on how the trial would affect the teenage victim, now 16 years old.

Prosecutors joined the defense in requesting that the judge reconsider the plea deal because, they said, the victim does not want to testify at trial. A psychiatrist testified at the hearing that testifying would be detrimental to the victim's emotional health.

Lafave faces two counts of lewd and lascivious battery and one count of lewd and lascivious exhibition. The judge will make a decision on the plea deal in seven to 10 days, he said.
