The Governor of Oregon has requested that the man charged with Brooke Wilberger's murder be returned to Oregon, but the 38-year-old man will probably face trial in New Mexico for kidnapping and rape charges first.

Joel Patrick Courtney was officially charged last month with the murder of Wilberger, who vanished in May 2004 from an apartment complex in Oregon that her sister managed. Wilberger was a student at Brigham Young University at the time.

A trial date has not been set for Courtney in New Mexico where he faces unrelated kidnapping and rape charges. He is not expected to be returned to Oregon until that trial is completed.
