Attorneys Seek Elizabeth Smart's Records

Attorneys for Brian David Mitchell, accused of the kidnapping of Elizabeth Smart, say the teenager's school and medical records are relevant to the case, but the attorney for the Smart family say the efforts to obtain the records are merely a ploy to get the family to agree to a lenient plea agreement.

Mitchell's lawyers have sought to obtain Elizabeth Smart's medical records, specifically those from the medical center where she was examined March 12, 2003, the day she was found with Mitchell and his wife, Wanda Barzee.

They have also requested school records from Smart's junior high and high school about her classes, grades, teachers, attendance and disciplinary actions. They have also requested a computer hard drive seized by police from the Smart's home during the investigation into her disappearance.

Greg Skordas, the attorney for the Smarts, has filed motions to block the requests. In court papers, he said the attempts were an effort to coerce the Smart family into agreeing to a lenient plea deal.

Elizabeth's father, Ed Smart, has said the family wants a quick resolution to the case and would prefer that it not go to trial.

I am an incest survivor who was threatened with death with a knife by my perpetrator and who suffered rapes, isolation, repeated abuse and trauma for years. I do not believe Elizabeth Smart. I feel that she was a rebellious teen who ran away. If I am wrong, and she was truly kidnapped, threatened with death and raped four times a day, then I feel she should quit telling other survivors of trauma, rape and abuse to simply ‘move on with their lives’ ‘let it go’ ‘don’t allow it to affect you.’ This is detrimental advice and impossible for a true victim to do.
