Scott Peterson Sentence and Civil Case Delayed

Tuesday January 25, 2005
The formal sentencing for convicted killer Scott Peterson has been delayed from Feb. 25 until March 11 because his attorneys said they need more time to prepare for the hearing and more time to prepare a motion to set aside Peterson's conviction and death sentence.

Meanwhile, Laci Peterson's mother, Sharon Rocha, is going forward with a wrongful death lawsuit against Peterson so that her former son-in-law will never be able to profit from his crimes. She is seeking more than $5 million in damages.

Peterson's lawyers say he has few assets and no plans to write a book or sell the movie rights to his story.

Sharon Rocha's attorney, Adam Stewart, says his client is the executor of Laci Peterson's estate and should inherit the couple's Modesto home and $256,429 from a life insurance policy.

The home has a $100,000 lien on it from a $100,000 loan Scott received from his parents. Stewart said the loan is a sham, since Peterson did not have enough equity to qualify for that amount of a loan.

The civil case has been delayed until April.
