Maryland's Anti-Spam Law Overturned

A judge dismissed a lawsuit against a New York email marketer, who was being sued under Maryland's 2002 Commercial Electronic Mail Act, ruling that the law is unconstitutional because it tries to regular commerce outside the state's borders. Eric Menhart, a George Washington University law student, has filed a series of lawsuit against spammers making false claims under the Maryland law, but the ruling virtually overturns that law. The ruling is expected to be appealed.
