Jurors Can't Consider Peterson's Family

Scott Peterson's defense attorney Mark Geragos requested that the jury be instructed that they could consider sympathy for Peterson's family in their penalty phases deliberations, because Laci Peterson's unborn child would have been their grandson too. Judge Alfred A. Delucchi denied the request, ruling that "sympathy for the defendant's family is not a matter the jury can consider in a capital case." Closing arguments in the penalty phase are expected today and the jury should begin deliberations Thursday on whether or not Peterson gets the death penalty.
