Mitchell Pleads Not Guilty in Smart Kidnapping

Brian David Mitchell answered "not guilty" today to six different charges related to the kidnapping of Elizabeth Smart from her Salt Lake City bedroom in June 2002. He is charged with kidnapping, two counts of aggravated sexual assault, two counts of aggravated burglary and conspiracy to commit aggravated kidnapping.
Mitchell's arraignment followed a ruling two days ago that he was mentally competent to stand trial. His wife, Wanda Barzee, has twice been declared incompetent to stand trial and is undergoing treatment at a state mental hospital.
Because Mitchell was indicted by a Utah grand jury, there will be no preliminary hearing in the case. The trial is scheduled for the first week in February 2005.
Mitchell, a street preacher and self-proclaimed prophet, was motivated by a "revelation from God" to kidnap Elizabeth, according to documents filed with the court.

System like a fiddle Mitchell is not incompetent
he just knows how to manipulate the system. Every time he breaks out in song, he knows
the Judge will immediately escort him out of
the court room, that way he won’t have to answer any questions. DA!!!!! I say Duck tape his mouth shut. To say he is incompetent is irrelevant,incompetent means you don’t know right from wrong. I am sure that his plan to kidnap Elizabeth Smart from her bedroom involved a lot of planning and was well thought out. If you were incompetent (quote

The defense is worried about all the anxiety Mitchell is going through, well how about the years of hell the Smart family have gone through. That goes back to the justice system how they protect all sexual predators. A slap on the wrist. I
hope now the Federal has the case they can force medication so he can stand trial.And justice will be served for the Smart Family.
He needs to be lock up for the rest of his life. He is dumb like a Fox!!!!!!!!!
